The manager of a fast food restaurant repeatedly failed to turn up for unpaid work given as punishment for assault and criminal damage, a court has been told.
Dennis Rossiter, 23, of 22 Gorwell Road, Barnstaple, appeared at North Devon Magistrates' Court on Friday when he accepted he had failed to attend for unpaid work on June 8 and October 3.
Since being handed the community order in January 2011 he had already appeared in court twice to be given further hours as punishment for not attending.
And he also failed to surrender to summons to court on November 7.
Rossiter told the court he had failed to make his first days work because he had been waiting to have an operation on his ear,
But he provided no proof of that.
Rossiter, who had no legal representation, told the court he had missed the next date for unpaid work after gaining a job.
"When doing unpaid work we popped into a local restaurant, Burger King, and I applied for a job," he said.
Rossiter's application was successful and within three months he was promoted to manager, he said, which means he now works six days a week and is taking management courses.
Melanie Wright, from the probation service, said she saw no reason the order should continue. She also said he had 18 hours and 45 minutes of unpaid work to complete.
Presiding magistrate Michael Buckley commended the fact Rossiter was working, saying: "Not withstanding the fact you're now in gainful employment, which is to be lauded, you've consistently ignored this order when it doesn't fit your timetable."
He decided to revoke the comunity order and give Rossiter a £200 fine and £15 victim surcharge.
