Spain's Official State Bulletin (BOE) published the Royal Decree 1025/2015 of 13 November (amending a previous one) on the conditions to be met by recycled raw materials based on polymeric materials for their use in packaging and other articles in contact with food.
The new regulation authorises the marketing and use of raw materials based on polyethylene terephthalate (PET) or other recycled plastics obtained in Spain for their use in plastic materials and other articles intended to come into contact with food, always as long as they meet the following conditions:
Firstly, that a favourable opinion on the recycling process is issued by the European Food Safety Authority (EFSA).
Secondly, a notification of the start of the material's manufacture to the health authorities of the autonomous region where the facilities are located in order to facilitate official controls.
Thirdly, that whoever is in charge of the recycling process can guarantee that "the PET, or other plastic material, has been obtained following the manufacturing conditions set up by the EFSA."
Lastly, that the operators using PET containers or other recycled plastic materials can guarantee their use in applications evaluated by the EFSA.
