A Philadelphia food warehouse must defend itself against a government lawsuit that claims the business was operating under insanitary conditions.
The U.S. Department of Justice has sought to enjoin New Rich City Trading Corp. from receiving, holding and distributing food unless it comes into compliance with federal law.
According to the complaint, inspectors with the U.S. Food and Drug Administration (FDA) found animals, feces and urine throughout the facility including on and around food. The lawsuit alleges the company is in violation of the Federal Food, Drug and Cosmetic Act.
"It is unacceptable for any distributor to expose the food we eat to animals, animal waste and other filth," U.S. Attorney Zane David Memeger said in a statement Wednesday. "The Department of Justice is committed to taking action against those who do not maintain and handle food in a clean environment."
Timothy F.T. Lee, a Philadelphia lawyer representing New Rich City Trading Corp., declined comment Friday. However, he told the Philadelphia Business Journal that the company sought to work with state and FDA inspectors to comply with the regulations.
