Diamond Foods informed to missed deadline for filling financial statements

Core Tip: US snack maker Diamond Foods has received a determination letter from Nasdaq, informing that the company has missed its deadline for filing the financial statements of its three most recent fiscal quarters.
Diamond Foods plans to request a hearing before a Nasdaq Hearings Panel. In the letter, Nasdaq noted that the hearing request will stay any delisting for an additional fifteen days, or until 5 July, 2012, unless Diamond requests that the stay be extended pending the hearing.

Diamond Foods intends to request that the stay remain in effect pending the hearing. During the period of the stay, the company plans to continue its work to finalize all of its delayed filings.

Recently, the company announced that it will be missing its 11 June deadline to report the restated financial statements, which could result in a delisting from the Nasdaq.

At that time, the company said that it had made considerable progress on completing the restatement for the fiscal years 2010 and 2011 as well as the reports for the first three quarters of 2012, and added that it plans to file its statements as soon as possible.
