Today, Magrama published in the Official Gazette (BOE) four orders homologating the standard contracts of sale of limes and grapefruit destined for the fresh market and industry for the 2016/2017 season.
These contracts are a useful, balanced and simple formal instrument, agreed by the whole industry, as well as by representatives of the production and trade within the sector. They are a balanced text that defend the interests of both parties, buyers and sellers, who freely agree on delivery terms, volumes, prices, quality specifications, payment terms, etc., in a global framework that provides maximum security.
AILIMPO, under Law 2/2000 of agricultural foods contracts, has been requesting Magrama to approve the contracts for the sale of limes and grapefruit destined for fresh market and industry for many campaigns, because of the need to give the production, commercial, and industrial sector a tool to comply with Law 12/2013. "These contracts are tailored to the demanding conditions set by the Law 12/2013 of the chain and offer the assurance of compliance with the obligations established in recruitment," said the director of AILIMPO, Jose Antonio Garcia.
Advantages of AILIMPO's official contracts
Some of the various advantages offered by these contracts are:
They are official contracts approved by Magrama and published in the Official Gazette.
They certify that the chain is complying with Law 12/2013.
They protect both parties , the buyer and seller, in a balanced way.
They regulate the conditions of sale in a clear and simple manner.
They allow the parties involved to achieve more profitability by avoiding conflicts and renegotiations.
In case of conflict between the parties, AILIMPO provides service mediation, and ultimately the case is sent to the Chamber of Commerce of Murcia for arbitration, thus avoiding going to the courts, which are always slower and more costly.
It's important to note that the clauses aim at providing greater information security and contractual warranty on traceability, phytosanitary treatments, fertilization, and certification of farms, as well as the quality requirements of the fruit and the procedure for the analysis of pesticides. "The contract becomes a tool that, in addition to certifying that the chain law is being met, allows the sector to guarantee the product's maximum quality and safety to customers. It enhances the image and prestige of our products in the markets for both fresh and industrial products," stated Jose Antonio Garcia.
Through AILIMPO, the Spanish lime and grapefruit sector continues to be a pioneer in adapting contracts to the new legal framework.
