Nestle India dragged to court on high ash content; company in the dark

Nestle India seems to have been dragged to the court again. This time as per claims by UPFDA officials, a law-suit has been filed with the additional district magistrate, Barabanki, UP. However, the company is not aware of this development.

In the latest instance, the Uttar Pradesh Food and Drug Administration (UPFDA) moved the court on receiving results from its Gorakhpur lab that the samples of Maggi 2- minute noodles that it collected few months ago and sent for testing, contained ash above permissible limits. The UPFDA alleged that the products were sub-standard.

Speaking to FnB News, Vijay Bahadur, additional commissioner (food), UPFDA, explained, “The state designated officers have filed a law-suit on Tuesday with the additional district magistrate, Barabanki, Uttar Pradesh. The results procured from Gorakhpur lab have shown that the ash content in the product of 'Maggi 2- minute noodles' exceeds permissible limits. Thus, UPFDA has furthered the action by filing a lawsuit in this regard by food safety inspectors.”

Meanwhile, denying the charges, Nestle India's spokesperson defended the company, saying, “We haven't received any notices as of now. If we receive any such notices then we will definitely file our reply accordingly.”

The spokesperson added, “We are not aware of any such charges and Nestle India ensures that its products meet quality standards. We at Nestle India ensure that our products are legally compliant according to the guidelines issued by the (Food Safety and Standards Authority of India) FSSAI.”

A state food safety official informed that the samples were procured last year and the notices in this regard were sent earlier but Nestle India had failed to file a reply to these notices, which forced the authorities to seek serious legal intervention by approaching the additional district magistrate.
