Duckhorn Vineyards of Napa Valley has filed a lawsuit against Duck Walk Vineyards for breaching the trademark contract, under which Duck Walk Vineyards was supposed to mention its location on the front side of its wine bottles.
In 2003, both the companies came to an agreement, wherein Duck Walk agreed to mention the wine's place of origin on the front label of its wines and also agreed not to produce more than 84,000gal of wine with the word 'Duck' or pictures of ducks on the label.
Following the lawsuit filed on 15 January 2013 in Napa County Superior Court, Duckhorn has now asked New York-based Duck Walk to modify the labels and stop sales of 50% of its wines outside New York, New Jersey and Connecticut, reported Napa Valley Register.
A San Francisco attorney Henry Bunsow, who represented Duckhorn Vineyards, claimed that Duck Walk Vineyards has not kept their promise according to the 2003 federal settlement.
However, Duck Walk lawyers said their client has followed the rules and Duckhorn does not own the word 'Duck.'
