The U.S. Department of Agriculture (USDA) has cited Liborio Markets #9 Inc. and Liborio Markets #10 Inc. for failure to pay for produce.

Liborio Markets #9 Inc. failed to pay $329,395 to 14 sellers for 232 lots of produce. Liborio Markets #10 Inc. failed to pay $425,599 to 13 sellers for 377 lots of produce. As a result of these actions, both companies cannot operate in the produce industry until Nov. 26, 2015, at which time they may apply for a PACA license.

The companies’ principals, John Alejo, Enrique J. Alejo, Enrique M. Alejo, and Liborio Holding Co., may not be employed by or affiliated with any PACA licensee until Nov. 26, 2014, and then only with the posting of a USDA-approved surety bond.

USDA is required to publish the finding that a business has committed willful, repeated, and flagrant violations of PACA as well as impose restrictions against those principals determined to be responsibly connected to the business during the violation period. Those individuals, including sole proprietors, partners, members, managers, officers, directors, or major stockholders may not be employed by or affiliated with any PACA licensee without USDA-approval.
