A federal appeals court has ruled in favor of 67 workers who sued Tyson Foods Inc. for failing to pay them for time spent donning and doffing protective gear. The class-action lawsuit was initiated in 2006.
The US Court of Appeals for the 10th Circuit said the evidence showed that Tyson had underpaid workers. The court also ruled that the US District Court for the District of Kansas was correct in approving a $3.38 million award for attorneys' fees.
A 2011 jury trial found in favor of the plaintiffs, however ,jurors awarded the plaintiffs $502,000. The plaintiffs had sought $6 million. Tyson appealed the attorneys' fees and the judgment.
